Terms & Conditions

1. Business Details

These Terms and Conditions (“Terms”) apply to all services provided by The KHandyman, operated by Kieran Hutchings, (“we”, “us”, “our”, “I”) to the client (“you”, “the customer”). By booking or accepting services from us, you agree to these Terms.

2. Scope of Services

We provide general handyman services, including but not limited to minor repairs, maintenance work, installations, and property improvements. All services are limited to tasks we are qualified and insured to perform. We reserve the right to refuse any job that is unsafe, illegal, or beyond our expertise.

3. Quotes and Pricing

Quotes may be provided verbally or in writing and are estimates unless explicitly stated as fixed-price. Additional work requested beyond the original scope may incur extra charges. All prices are inclusive of VAT. Prices may change if unforeseen issues arise (e.g., hidden damage, unsafe conditions). You will be informed and asked to approve any additional costs before work continues where reasonably possible. Any quotes over £250 require a 20% deposit which must be paid 24 hours before work commences.

4. Payments

Payment is due 7 days after the issue of an invoice unless otherwise agreed in writing. Accepted payment methods: cash or bank transfer. Cheques cannot be accepted. We reserve the right to withhold future services for unpaid balances.

4.2 Late Payment Penalties

Payments not received within 7 days of the due date specified on the invoice will incur:

  1. A late payment fee of £75 or 5% of the outstanding balance, whichever is greater.
  2. Interest at a rate of 8% above the Bank of England base rate, calculated daily from the due date until the balance is fully settled.
  3. If the balance remains unpaid, an additional late fee of £75 or 5% of the outstanding balance (whichever is greater) will be applied weekly.

4.3 Grace Period and Escalation

If the balance remains unpaid for more than 14 days, The KHandyman reserves the right to escalate the matter to a collections agency or initiate legal proceedings. All associated costs, including legal fees and collection charges, will be added to the outstanding balance.

5. Cancellations and Rescheduling

Cancellations must be made at least 48 hours before the scheduled appointment. We may reschedule due to weather, illness, or circumstances beyond our control.

5.2 Cancellation Fees

  1. Customer-Initiated Cancellations

    If a project is canceled by the customer less than 48 hours before the agreed start date, a cancellation fee will apply. The cancellation fee will consist of: • 100% of the cost of materials already purchased or specifically ordered for the project. • Up to 50% of the agreed labor cost, depending on the amount of notice provided.

  2. Materials

    If materials have been purchased before the cancellation, the customer is responsible for covering their full cost. These materials will be retained by KHandyman unless delivery to the customer is requested; however , a delivery fee of 5-10% will apply for the material costs.

  3. Labor Costs

    Labor costs charged as part of the cancellation fee are intended to cover lost time and scheduling impacts.

  4. Exceptions

    If the cancellation is due to exceptional circumstances, such as unforeseen emergencies, The KHandyman may waive or adjust fees at its discretion.

  5. Payment of Fees

    Cancellation fees are due within 7 days of the cancellation date and will be invoiced accordingly.

6. Customer Responsibilities

You agree to provide safe access to the property, ensure utilities (water, electricity, gas) are available if required, secure pets and remove hazards from work areas, and obtain any required permissions (landlord, HOA, building management). We are not responsible for delays or additional costs caused by failure to meet these requirements.

7. Materials and Parts

Materials supplied by us remain our property until paid in full. We are not responsible for defects in customer-supplied materials. Manufacturer warranties apply to materials where applicable; labor warranties are separate.

8. Workmanship Warranty

We warrant our workmanship for 12 Months from the completion date. This warranty does not cover normal wear and tear, misuse, neglect, or alterations by others, pre-existing issues or hidden defects, or materials supplied by the customer.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our liability is limited to the cost of the services provided. We are not responsible for damage caused by underlying issues, structural defects, or faulty previous work.

10. Health and Safety

We comply with applicable health and safety regulations. You acknowledge that some handyman work involves inherent risks, especially when working on older or damaged properties.

11. Completion Timeline

An estimated timeline for project completion will be provided, with allowances for unforeseen circumstances such as extreme weather conditions, material availability delays, or unforeseen site conditions. The Company will make reasonable efforts to notify clients of any delays and provide updated timelines accordingly.

12. Photos and Marketing

We may take before-and-after photos for records or marketing. Permission will be asked verbally before any such photos are obtained. All Marketing material will be checked before publication, and any personal artifacts such as family photos etc will be removed/censored. The client retains the right to have any publicised photos of the work removed from public view at any time.

13. Customer Reviews and Testimonials

The KHandyman values feedback from our clients and strives to continuously improve our services. With the client's consent, we may request feedback and testimonials upon completion of the project to showcase our work and service quality to future clients. Client testimonials and reviews may be used for marketing and promotional purposes, including but not limited to website content, social media posts, and printed materials. Clients who provide testimonials or reviews may request anonymity or opt-out of having their feedback shared publicly. The KHandyman respects the privacy preferences of our clients and will honour any such requests promptly.

14. Waste Disposal

Unless otherwise agreed upon in writing prior to the commencement of the project, the client is responsible for the disposal of any waste materials generated. The client agrees to ensure proper disposal of waste materials in accordance with local regulations and environmental guidelines. Failure to do so may result in additional fees or penalties imposed by local authorities. If the client wishes to delegate waste disposal responsibilities to KHandyman, it must be discussed and agreed upon in writing prior to the start of the project. Additional charges may apply for waste disposal services provided by the Company. The Company shall not be liable for any costs, damages, or liabilities arising from the client's failure to properly dispose of waste materials in compliance with applicable laws and regulations.

15. Client Satisfaction

The Company values client satisfaction and encourages open communication throughout the project. Clients are requested to promptly communicate any concerns or issues regarding the completed work within 14 days of project completion. The Company will make reasonable efforts to address and resolve any concerns in a timely manner.

16. Intellectual Property

The Company retains ownership of any designs, plans, or other intellectual property created during the course of the project.

17. Force Majeure

The Company is not liable for delays or failure to perform due to circumstances beyond its control, such as acts of nature, government actions, or supplier shortages.

18. Confidentiality

Both parties agree to keep any confidential information shared during the course of the project confidential and not to disclose it to third parties without prior written consent, unless required by law. Confidential information includes but is not limited to project details, financial information, and trade secrets.

19. Indemnification

The client agrees to indemnify and hold The KHandyman harmless from any claims, damages, or liabilities arising out of or related to the client's breach of these terms and conditions, negligence, or failure to comply with local building regulations. This includes but is not limited to claims related to property damage, personal injury, or disputes with subcontractors.

20. Right to Walk Away

The KHandyman reserves the right to terminate the agreement and walk away from the job if the client fails to adhere to the terms and conditions outlined herein, or if unforeseen circumstances arise that prevent the Company from completing the work in a satisfactory manner.

21. Additional Costs

While every effort will be made to provide an accurate estimate for the project, the client acknowledges that unforeseen circumstances or changes in the scope of work may result in additional costs. The Company will promptly notify the client of any additional costs incurred and obtain approval before proceeding with the work.

22. Governing Law

This agreement shall be governed by and construed in accordance with the laws of The United Kingdom, and any disputes shall be subject to the exclusive jurisdiction of the courts of The United Kingdom.

23. Sever ability

If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

24. Changes to Terms

We may update these Terms from time to time. The latest version will apply to all new bookings.

25. Acceptance

By booking or allowing us to carry out work, you confirm that you have read, understood, and agreed to these Terms and Conditions.
